New York Goes to the Mattresses Against the Eviction Machine

As the Trump era drags on, the hope that cities would be bastions of resistance has melted into air. In some cases, cities don’t have the authority to serve as an effective bulwark against Republican control of statehouses and Washington, and against federal agencies like ICE. In others, they don’t have the capacity to preserve or increase protections for the poor and vulnerable.

But there is still room for big, simple victories, like the idea Mark Levine, a city councilman from upper Manhattan, has been working on since 2014: Hire lawyers for tenants in housing court. On Thursday, the New York City Council passed a bill that will guarantee, within five years, legal representation for all low-income tenants facing eviction. Mayor Bill de Blasio has indicated he will sign it. An independent study commissioned by the New York City Bar Association estimated the law could keep more than 5,000 families from homelessness every year.

Of all the ways that the American financial and legal system leaves renters at a disadvantage, you’d be hard-pressed to find a more unequal terrain than housing court. Nationwide, 90 percent of landlords have attorneys, but 90 percent of tenants do not. Tenants don’t show up to defend themselves or don’t know how. In a randomized experiment performed by the Legal Aid Society, eviction warrants declined 77 percent when the tenant had counsel.

Here are the numbers in New York: There are more than 150,000 housing court cases a year. More than 120,000 tenants would qualify for representation under New York’s new law, which offers counsel for households under 200 percent of the federal poverty line (about $50,000 for a family of four). Currently, fewer than 3 in 10 low-income households go to court with a lawyer. There are more than 20,000 evictions each year, and nearly half of all families in homeless shelters are thought to wind up there after eviction.

No complex legal reasoning is required here. Policymakers think lawyers can throw a wrench in the eviction machine simply because tenants often have a good case for not paying rent. In Baltimore, research by the Public Justice Center showed that 80 percent of renters facing eviction lived in units with serious defects “like vermin infestation, toxic mold, or broken appliances.” Just 8 percent of tenants had their claims heard by a judge; most either didn’t show up, or didn’t defend themselves.

In a rapacious housing market like New York’s, the profit motive behind evictions can be enormous—especially when the tenant occupies a rent-stabilized apartment that can be deregulated through vacancy. That means evictions eat away the rent-stabilized stock, which is by far the city’s cheapest way to preserve affordable housing. Meanwhile, rising rents make it harder and harder for the homeless to get back into apartments. The average length of shelter stay for families with children is over a year. The city’s shelter population is more than 60,000—the size of Palo Alto, California.

It will cost a lot to provide lawyers for 120,000 housing court cases a year: More than $200 million, by some estimates. (Then again, the progressive prince of Albany wants to spend more than that on a light show.) Under Mayor Bill de Blasio, the city has already allocated $64 million a year to tenant legal services, up from $6 million in 2013—a move correlated with an 18 percent drop in evictions.

The independent analysis, prepared by the consulting firm Stout Risius Ross, projects the policy will save New York money on balance: more than $100 million a year. Each case might cost an average of $2,500, Levine says, but each shelter stay costs the city nearly $45,000 a year. “You don’t have to avoid too many homeless cases before you recoup what you’re spending up front,” he explains.

And none of those balance sheets account for the social benefits that accrue from residential stability when a family can maintain access to the same schools, social network, and jobs. Studies suggest that eviction leads to job loss more than job loss leads to eviction.

This is not just a high-cost city problem. In Milwaukee, where Matthew Desmond set his Pulitzer Prize–winning book Evicted, there were 16,000 evictions a year in a city of just over 100,000 renter households. The numbers were similar in Kansas City, Cleveland, Chicago, and elsewhere, he wrote.

The basic right to counsel, affirmed by the Supreme Court in Gideon v. Wainwright for felony charges, has since been expanded to include a variety of cases. Housing court isn’t one of them. Organizations that provide lawyers to tenants have to turn away most cases, though just the presence of a lawyer can stop an eviction. (There’s even an app that helps New York City tenants turn their complaints into properly formatted documents, an indication of how even the most basic preparation can tip the scales in their favor.)

Not surprisingly, other cities are working on similar policies. In May, Washington, D.C. approved a $4.5 million pilot to defend low-income tenants. Kenyan McDuffie, the councilmember who sponsored the legislation, told WAMU, “I’d love to get where it’s a full civil Gideon where we are guaranteeing a right to counsel in areas where the stakes are extremely high for people in civil court.”

Philadelphia, where counted 20,000 annual evictions between 2014 and 2015, allocated a $500,000 grant to defend tenants earlier this month. Baltimore spent twice as much helping landlords evict tenants ($2.7 million on sheriff’s deputies to oversee 6,500 evictions) than it did helping tenants stay in their homes ($1.3 million). On Monday, Baltimore City Councilman Robert Stokes proposed an anti-eviction fund.

But New York’s program remains an outlier in both its scale and expense. Housing court functions as a weapon, Levine likes to say. After we spoke on Thursday, he called back with one more thought: “We’ve had a flood of inquiries in cities who are excited about it. This really proves that even in the Trump era we can still score wins at the local level. This proves that we still have the power.”

Not much power. But if you know how to use it, maybe you can get something done.

Chances are you haven't thought much lately about the economic tragedy that's unfolding in Puerto Rico. Not with nukes in North Korea and neo-Nazis and Obamacare repeal to dwell on. But Thursday at the New York Times, Mark Weisbrot of the Center for Economic and Policy Research has written a grim reminder that, in the wake of the island's debt crisis, we've essentially sentenced it to another decade of austerity-fueled economic depression.

Puerto Rico has been in a recession more or less continuously since 2007, which helped force it into an unsustainable spiral of borrowing that ended in default last year. Congress responded to the growing crisis by passing PROMESA, an act that placed the territory under the oversight of a bipartisan financial control board. This March, that panel finally approved a fiscal repair plan meant to close Puerto Rico's budget deficit while setting aside some money for bondholders. There’s an upsetting assumption behind this road map: that it will face another full 10 years of stagnation. As this graph from the plan shows, the territory's economy isn't expected to start growing again until 2022.

Even then, the island's economy will still be smaller in 2026 than it is today, even before accounting for inflation.

And that's probably too optimistic. As Weisbrot writes, the plan doesn't factor in the effects of austerity,  “which would add more years of decline.” More generally, these sorts of debt-sustainability projections are notoriously too sanguine about the ability of governments to keep paying their creditors while absorbing deep budget cuts. We've seen this show play out repeatedly in Greece, where international technocrats spent years making fanciful projections about how the country could slash its spending, raise taxes, gradually bounce back from a depression, and somehow make good on its (reduced) debts. The difference is that, as John Jay College economics professor J.W. Mason notes, Puerto Rico is just now entering into an austerity plan after already experiencing an employment collapse similar to Greece's. And if you take the official projections seriously, Puerto Rico's economy—measured by gross national product—should reach Greece's recent nadir within the next few years.

Europe's austerity politics have reduced Greece to a perpetual economic crisis. We're handing Puerto Rico the same prescription, and bizarrely expecting different results.

Iowa Wants to Rewrite Obamacare. What Happens if Trump Lets It?

Right now, the second most important health care story in the country may well be unfolding in Iowa.

The most important story, of course, is the Senate GOP’s attempt to craft an Obamacare repeal bill entirely behind closed doors. But if that effort sputters—God willing—the future of the Affordable Care Act, and the extent to which conservative-leaning states will be able to simply rewrite it on their own, could hinge on what’s currently taking place in Des Moines.

This week, Iowa submitted a plan to federal regulators meant to stave off the impending collapse of its individual insurance market. There is currently a strong possibility that, come 2018, Iowa could become the first state without any carriers offering coverage on its Obamacare exchanges. Of the four insurers currently operating there, two—Aetna and Wellmark—have said they will pull out of the state’s market entirely next year because of the losses they’ve piled up there. Another, Gundersen, only sells coverage in five counties and hasn’t committed to sticking around. The last, Medica, offers health plans across the entire state but has warned it may have to bail ”without swift action by the state or Congress to provide stability to Iowa’s individual market.” If the company does exit, Iowa’s exchanges will be more barren than a cornfield in January.

Insurers are losing money on Iowa’s Obamacare exchanges, and fleeing them, for essentially the same reason they are elsewhere: Their customers have turned out to be older and sicker than anticipated. But those problems are especially acute in lightly populated rural states like Iowa, where the government has made matters worse by letting many residents hold on to their pre-Obamacare insurance plans rather than force them onto the exchanges. That’s made the pool of customers thinner than it might otherwise have been. Much has been made of the fact that Wellmark, which lost $90 million over three years, got stuck covering a young hemophiliac whose medical bills cost the company $1 million per month. But the fact that a single teenager with a rare condition could turn into a budget line item for an insurer is really just a colorful illustration of how tiny and unbalanced Iowa’s individual market really is.

Of course, it also doesn’t help matters that Donald Trump is threatening to bring all of Obamacare crumbling down by withholding crucial subsidy payments from insurers.

With the threat of disaster looming, Iowa officials have asked the U.S. Department of Health and Human Services for permission to implement a “stop-gap” measure that would let them dramatically rewrite the rules of Obamacare within their state, at least until Congress figures out what it wants to do about health care. As Larry Levitt of the Kaiser Family Foundation put it to me, their plan is a bit like a mashup of the American Health Care Act, which House Republicans passed last month, and the Affordable Care Act—in other words, Trumpcare lite.

Under the proposal, Iowa’s individual insurers would only be allowed to sell a single, standardized health policy—the equivalent of an Obamacare silver plan—which would be offered off of the ACA’s online exchanges. Insurers would still be required to cover the essential medical services required under Obamacare, and carriers would still be banned from discriminating against customers with pre-existing conditions. But the state would replace Obamacare’s subsidies with tax credits that would be available to higher earners (they’d scale based on age and income) and would no longer require insurers to reduce out-of-pocket costs for poorer customers. Finally, it would add new enrollment restrictions aimed at keeping people from waiting until they were sick to buy coverage and—borrowing from the House bill—would create a large reinsurance pool to defray costs for insurers who get stuck covering extremely expensive patients.

It’s a fairly dramatic rewrite. Low-income Iowans could come out a bit worse in the bargain while some upper-middle-class residents would come out ahead. Meanwhile, insurers would be less likely to lose money if they have to cover a severe case of hemophilia. While those trade-offs might not be entirely ideal to some, it could keep the insurance market functioning. Wellmark has said it would keep selling coverage in Iowa if the proposal—which it reportedly helped negotiate—is implemented. And a health care landscape with one or two insurers beats a health care landscape with no insurers.

But can Iowa legally do it? That’s not exactly clear. Under current law, the federal government is allowed to let states tear up Obamacare’s rules and experiment with new insurance systems through what are known as 1332 innovation waivers. But those come with a number of strict requirements—among them, states need to show they’d provide coverage that was just as affordable and comprehensive as under Obamacare while also providing a 10-year forecast showing the changes would be budget-neutral to the federal government. It’s not clear Iowa can actually hit all three of those marks at once, or check the many procedural boxes necessary for a waiver—and so the state is asking the administration to relax the rules. “The ‘traditional’ 1332 Innovation waiver was designed to allow states to propose innovative and long-term changes to the functions of the ACA,” its proposal says. “Iowa’s proposal is a short-term solution to prevent the crisis of not having any carriers offering ACA compliant plans in 2018.”

The subtext of Iowa’s proposal seems to be that Republicans will have repealed and replaced Obamacare by 2019, at which point it won’t really matter whether their system meets the waiver program’s strict requirements. (“Iowa intends to revisit the functionality of this program in lieu of any federal guidance that may be applicable for 2019,” the proposal says.) But if Mitch McConnell & co. bungle that effort, giving Iowa a green light to revamp Obamacare, no questions asked, could create a new and potentially powerful precedent. Sure, the state is framing this as a one-time response to an emergency situation. But what counts as an emergency? If a red state found itself with just a few counties lacking insurers, would the Trump administration let it do a top-down rewrite of the law? And what if Trump did decide to eventually cut off those crucial subsidies and bring the ACA markets crashing down? In that case, many states might be able to make a case for emergency measures. Maybe activist groups would sue to stop them from rewriting the law, but if the alternative is a cratered insurance market, maybe not. Under this scenario, we could end up with a landscape of states with radically different health-care regimes—some that look like Obamacare, some that look like Trumpcare, and some, like Iowa’s, that are Frankensteins of the two.

Iowa is facing a legitimate crisis, and many of the steps it’s taking to fix it make sense. But the state is also showing how conservatives could try to kill off Obamacare by regulatory fiat if they can’t pull off the job on Capitol Hill.
